Kepastian Hukum Perjanjian Pengikatan Jual Beli (PPJB) dan Kuasa Menjual yang Dibatalkan oleh Pengadilan

Abstract

This study examines the legal certainty of a Sale and Purchase Binding Agreement (PPJB) and Power of Attorney to Sell Canceled by the Court. It employs a normative-juridical research method specifically, library based legal research utilizing primary, secondary, and tertiary legal sources. The findings indicate that regarding a PPJB annulled by a court, legal certainty arises once a court judgment with permanent legal force clarifies the agreement's status, the positions of the parties involved, and the legal consequences to be implemented. The annulment of the PPJB means that the legal relationship stemming from the agreement can no longer serve as a basis for demanding the execution of the sale and purchase as originally agreed. The parties are obliged to respect and carry out the legal consequences stipulated in the court judgment.
